Summary of Exhibitor Indemnity

What is an Exhibitor Indemnity?

As an exhibitor, it’s vital you have in place measures to mitigate the risk of claims against you by third parties for damage to property or bodily injury related to your hire of space at the venue. To this end, ICA Events provides a contractual indemnity in your favour as part of its hire to you of your space. This Exhibitor Indemnity means that (subject to certain limitations and conditions) ICA Events will pay third party public liability claims and third party property claims made against you in connection with your hire of the space.

Does the Exhibitor Indemnity meet all of my requirements?

The Exhibitor Indemnity is limited and provides some basic protection in areas which ICA Events considers relevant for exhibiting. You need to review your individual requirements and, if you do not feel the Exhibitor Indemnity is sufficient for your needs, you should consider alternative ways of covering your obligations, such as insurance.

Who is covered by the Exhibitor Indemnity?

The Exhibitor Indemnity only covers you and your staff while they are working for you at the venue. It is your responsibility to ensure any other company exhibiting on your stand can adequately meet their potential obligations in the event of any incident.

Can I still buy insurance?

You can and should consider having insurance in addition to the Exhibitor Indemnity because it is limited and subject to conditions.

It is very important that you read the terms of the Hire Space Contract and the below summary in full to ensure you understand the terms of the Exhibitor Indemnity, the significant limitations and what obligations you must fulfil in order to utilise it.

What is included in the Exhibitor Indemnity? This document sets out certain key covers that are included in the Exhibitors benefits package.

  • ICA Events will reimburse you up to £2,000,000 for each occurrence that you become legally responsible to pay in respect of third-party bodily injury or third party property damage, and ICA Events will not pay the first £250 of each claim
  • ICA Events will pay your reasonable defence costs for each occurrence.
What is not included under the Exhibitor Indemnity? This document sets out certain key exclusions which limit the indemnity.

The Exhibitor Indemnity does not cover loss of or damage to your own property or property under your control, except for personal affects.

The Exhibitor Indemnity excludes all claims resulting from the following:

    • claims arising from USA or Canadian based legal action;
    • war, terrorism, radioactive contamination, pollution, nuclear risk, malicious use of poisonous biological or chemical materials;
    • communicable disease, or your products, except food and drink you provide in the course of the insured event.;
    • cyber incidents, including any computer or digital technology error, social engineering communication, cyber-attack or hacker;
    • any form of data;
    • libel, slander, defamation of character, deceit, injurious falsehood, discrimination, harassment or advertising injury;
    • employment dispute issues;
    • hazardous activities;
    • the sale or supply of goods, except food or drink you supplied during the event;
    • Transmission of any communicable disease
    • Deliberate, wilful or any act of vandalism at or to the venue

Vento is appointed by ICA Events to administer claims under the Exhibitor Indemnity.

What if I need to make a claim? In the event of any incident, happening or circumstance which could give rise to a claim, you must:

  • Contact Vento as soon as reasonably possible, confirming all facts in writing with all information that is available.
    • If you do not notify Vento as soon as reasonably possible and the delay prevents a full claim investigation, your claim may not be dealt with.
  • ICA Events will notify their insurers of any potential claim, and at the same time authorise [Vento] to liaise direct with you.
  • Vento will contact you, at which point you will be required to:
    • Provide all facts in writing with all information available;
    • Forward any unanswered letter of claim, writ, or summons immediately they are received by you, including all associated documents and any other written evidence of claim and provide consult regarding the response to be sent to any such correspondence.
  • You must NOT make any admission of liability or offer of payment.
  • You MUST take all reasonable steps to minimise or avoid a loss.
  • You MUST provide information, documents and assistance requested as soon as reasonably possible.
  • So far as in your power, you shall ensure your employees and all other persons interested in the event comply with the above.
